Cooperation with the SIGMA Programme in 2016

In 2016, the NAUCS continued cooperation with the SIGMA Programme on the Law of Ukraine “On Civil Service” as of 10.12.2016 No 889-VIII, the draft Law of Ukraine “On Local Self-Government in Ukraine”, Strategy of Public Administration Reform in Ukraine for 2016–2020 that was approved by the Order of the Cabinet of Ministers of Ukraine “Some questions of reforming of public administration of Ukraine” as of 24.07.2016 No 474-r.

Law of Ukraine “On Civil Service”

The Verkhovna Rada of Ukraine adopted the Law of Ukraine “On Civil Service” as of 10.12.2015 No 889-VIII, which came into force on 01.05.2016 pursuant to and in accordance with the decisions of the Parliament, the President of Ukraine and the Government as well as in accordance with international commitments undertaken by Ukraine.

The drafting of secondary legislation in the area of civil service, aimed at implementing the Law was provided by the NAUCS as well as events (matching procedures and working meetings) with the participation of relevant central executive authorities, international experts, representatives of other government authorities and civil society were held in order to implement provisions of the Law.

In addition, the NAUCS with the assistance of the EU Delegation to Ukraine organized the cooperation with international experts of OECD/SIGMA Programme. These communicative events with participation of European experts in order to discuss the drafts of regulatory acts to the Law of Ukraine “On Civil Service” as of 10.12.2015 No 889-VIII were held during 2016–2017:

  • expert mission (15–18 March, 2016), during which the general and line-item comments on the draft normative-regulatory acts to the Law of Ukraine “On Civil Service” that were provided by the experts of the SIGMA Programme, in particular issues on Commission on Senior Civil Service, criteria for determining positions that perform the functions of maintenance, competitive selection for civil service positions as well as order of election of representatives of public associations, scientific and educational institutions of the Commission on Senior Civil Service were discussed. Furthermore, approaches to determining the requirements for positions of categories A, B and C, the procedure for determination and approval of Typical requirements for candidates for civil service positions of B and C categories as well as the remuneration system were discussed.
  • expert mission (13–15 April, 2016), during which the general amendments to the drafts of the secondary legislation acts on salary system of civil servants, persons holding an political posts as well as representatives of executive support services were discussed. In addition, the drafts of the secondary legislation acts on rules of ethical conduct for civil servants and officials of local authorities as well as an evaluation of results of performance of civil servants were reviewed.
  • expert mission (18–19 May, 2016), during which the key issues on raising the professional competences of civil servants were reviewed as well as suggestions and comments to the draft Resolution of the Cabinet of Ministers of Ukraine “On Approval of Standard Order of Evaluating Results of Service Activity of Civil Servants” were presented.  
  • working meeting (21 September, 2016), during which the main outcomes within the framework of the implementation of the Law of Ukraine “On Civil Service” were discussed. Agreement on further cooperation between the NAUCS and SIGMA Programme on public administration reform and civil service reform based on the European principles of public administration in the context of the realization of the new legislation on civil service was achieved as the result of the meeting.
  • expert mission (07–11 November, 2016), during which the project concept of the Staffing Forms Reform and other accompanying documents were discussed as well as the general approaches for implementation of public administration reform were identified. Furthermore, the draft SIGMA Work Plan for January, 2017 – June, 2018 was discussed.
  • expert mission (29–30 November, 2016), during which SIGMA’s initial proposal on the training programme for State Secretaries as well as their responsibilities, competences and needs for professional development were discussed. In addition, the draft of amendments to the Law of Ukraine “On Civil Service”, the draft of the Regulations on Public Reporting of Executive Heads, normative and legal acts on the civil service was reviewed. SIGMA Programme experts also had a working meeting with members of the Commission on Senior Civil Service and discussed the issues on the identifying of needs in professional development of State Secretaries.
  • consultations with the EU Advisory Team within the framework of the Fifth Working Visit of the EU Advisory Team on the reforming of “Civil Service and Human Resource Management” (31 January – 02 February, 2017), during which the issues on the public administration reform and implementation of the Strategy for Public Administration Reform in Ukraine for 2016–2020 were discussed. Furthermore, experts of the EU Advisory Team presented the outcomes of work in areas of civil service reform, implementation of the Reform Staff Positions Concept (based on the final practice experience and evaluation of the EU Advisory Team and SIGMA Programme). The report based on the results of headcount analysis of civil servants of Ukraine and the EU Member States was presented. Also the EU Advisory Team submitted the recommendations on monitoring of number of civil servants. Furthermore, the amendments to the Law of Ukraine “On Civil Service” and key steps to establish a post of reform issues expert in the state authorities were discussed.

OECD/SIGMA Programme experts, representatives of Presidential Administration of Ukraine, Secretariat of the Cabinet of Ministers of Ukraine, Ministry of Economic Development and Trade of Ukraine, Ministry of Finance of Ukraine, Ministry of Social Policy of Ukraine, National Agency of Ukraine on Civil Service, Center for Adaptation of the Civil Service to the Standards of the European Union, members of the Expert Advisory Board on Civil Service Reform under the National Agency of Ukraine on Civil Service and others also took part in the working meetings.

Strategy of Public Administration Reform in Ukraine for 2016–2020

The NAUCS  in cooperation with the Government Office for European Integration of the Secretariat of the Cabinet of Ministers of Ukraine, Ministry of Finance of Ukraine, Ministry of Justice of Ukraine and other concerned central executive authorities with the representatives of civil society ensured revision of the Strategy of Public Administration Reform in Ukraine for 2016–2020, which was developed in order to strengthen general management and administration capacity of government apparatus within good governance and best practices of EU Member States, transformation it into effective instrument of continuous and sustainable development of government. It was approved by the Order of the Cabinet of Ministers of Ukraine “Some Questions of Reforming of Public Administration of Ukraine” as of 24.06.2016 No 474-r.

Currently the process of implementing the Strategy, in which the NAUCS is identified as responsible authority for the implementation of one of its key areas of “Public Service and Human Resource Management” is started.

Communication activities abroad:

  • On May 10, 2016 Ukrainian delegation consisting of the Head of the NAUCS  Kostiantyn Vashchenko, First Deputy Minister of Justice of Ukraine Natalia Sevostyanova, Deputy Minister of Justice of Ukraine — Head of Staff Anna Onishchenko participated in the regional conference of OECD/SIGMA Programme on The Principles of Public Administration: A Framework for ENP Countries (Amman, Hashemite Kingdom of Jordan).

The event was organized by the European Commission and OECD/SIGMA Programme jointly with Ministry of Planning and International Cooperation of the Hashemite Kingdom of Jordan in order to discuss the issue on public administration reform in Eastern Partnership countries and present the project “The Principles of Public Administration: A Framework for ENP Countries”, which was developed by the OECD/SIGMA Programme in cooperation with the European Commission.

The conference was attended by representatives from over 30 countries, who shared their vision of reforming the civil service and their experience on these issues.

Head of the NAUCS introduced Ukrainian experience in implementation of public administration reform, in particular civil service reform as well as the main outcomes and challenges that arise during development process of effective public administration system. Furthermore, Head of the NAUCS conducted a number of other working meetings, including the meeting with Head of the SIGMA Programme Karen Hill.

On June 08–11, 2016 the representative of Twinning Programme Administrative Office participated in the Annual Meeting of the National Contact Points nor the Institution Building instruments Twinning, TAIEX and SIGMA programme “Institution Building Days – 2016” (Brussels, Kingdom of Belgium).
