During the whole period of independence system of state administration of Ukraine of the "soviet" times with its command and administrative approaches has not been broken. Despite fact that European integration of Ukraine was claimed as the main priority, it has not been strength with real steps.
Functional reviews belong to principal mechanisms of reaching systemic optimization of performance, increasing efficiency and effectiveness of all bodies of executive power in Ukraine/ The reason is that functional reviews include optimization of functions performed by central executive power bodies as their essential component. The systemic optimization aims at creating a clear structure of executive power where each component will be responsible for a particular sphere of public relations, where functions shall not be duplicated, shall not exceed competencies and shall be aimed at the development and further improvement of power system in Ukraine.
A solid legislative and organizational framework for the implementation of functional reviews was formed in 2005-2007. In that period, the Procedure of carrying out a functional review of executive power bodies was elaborated, ratified by an order of the Main Deparment of the Civil Service of Ukraine from 29.07.2005 # 189 and registred in the Ministry of Justice of Ukraine on 17.08.2005 under # 901/11181, and two pilot projects were carried out in the Ministry of Economy of Ukraine and the Ministry of Transport and Commnucations of Ukraine. In addition, an order of the Cabinet of Ministers of Ukraine “On Formation of the Coordination Council on the Conduct of Functional Review of Central Bodies of Executive Power” was approved on 16.11.2006, followed by the establishment of working groups on functional review in all ministries and the organization of a first meeting of the above-noted Coordination Council. The Council’s decision set a schedule of functional reviews of central executive power bodies in 2007. Functional reviews in 2008 In 2008, Center for Adaptation of the Civil Service to the Standards of the European Union carried out a comprehensive horizontal functional review of executive power bodies. On the basis of analyzing the Ukrainian legislation (Laws and codes of Ukraine, decrees and orders of the President of Ukraine, resolutions and orders of the Cabinet of Ministers of Ukraine, resolutions of the Verkhovna Rada of Ukraine and orders of central executive power bodies), a primary list of public functions was compiled. Functions of 63 central executive power bodies, including ministries, central and national committees, commissions, departments and agencies, were singled out. The primary list of public functions was endorsed by central executive power bodies, and functions were evaluated in a view of redundancy, duplication and lack thereof. In the process of direct cooperation with central executive power bodies, a final list of functions of each executive authority was compiled. The efforts on compiling the final list included the removal of inactive, legally unregulated, and duplicate functions and the incorporation of the functions that ought to be performed. Currently, the list of public functions and services contains 8792 entries. A system of inquiries to use with this database, to add and edit entries is being finalized. A separate horizontal functional review of the distribution of functional powers among territorial units (bodies) of central executive authorities, on one hand, and local state administrations and local government bodies, on another hand, was implemented. Functional reviews of central and local executive power bodies, local government bodies ib the context of the preparation and conduct of the European Soccer Championship Finals in 2012 (Euro 2012) had become a separate sphere of the Center’s activity in 2008. Twenty-five (25) central and seven (7) local executive authorities, and six (6) self-government bodies were involved in this functional review. Based on the results, the Main Department of the Civil Service of Ukraine prepared a report which has been introduced to the Cabinet of Ministers of Ukraine. This report outlines the delegation of responsibility between interested parties, the status of inter-agency coordination, the status of the National Agency for the preparation and implementation of the European soccer championship finals in 2012, the institutional and personnel provisions necessary to support the preparatory process, the main challenges as well as recommendations on how to introduce improvements/adjustments. Further to discussion of the report, the MDCSU developed a draft resolution of the Cabinet of Ministers of Ukraine on approval of the standard regulations of oblast state administration divisions (department) on issues respecting the preparation and implementation of the European football championship finals in 2012 in Ukraine. The resolution was endorsed by the Cabinet of Ministers of Ukraine on 03.12.08. Functional reviews in 2009 In 2009, the priority spheres of carrying out functional reviews included the following: - development of recommendations respecting a new structure and system of central executive power bodies upon the results of the horizontal functional reviews; - implementation of functional reviews in the government bodies working in the sphere of labour and social protection of citizens with the purpose of improving the structure of managing the system of social services, in compliance with the Concept of reforming the system of social services for the period till 2012 that was approved by a resolution of the Cabinet of Ministers of Ukraine of 13.04.07 # 178-р; - implementation of a functional review of the Ministry of Regional Development and Building of Ukraine with the purpose of making proposals on how to optimize its structure; - implementation of a functional review in order to compile a register of public paid services within the framework of implementing the order of the Cabinet of Ministers of Ukraine from 25.02.09 # 251-р „On measures towards systemization of public paid services”. The main achievement of our work in this sphere in 2009 was creation of Register of State and Administrative Services, which is currently functioning via our web-site.
